These Terms of Service constitute a legally binding agreement between you ("Customer", "User", "Shipper") and Global Worldwide Express Shipping ("GWE", "we", "us", "our").
By accessing or using the Global Worldwide Express Shipping website, mobile application, or any shipping services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not use our services. These terms apply to all users, including shippers, consignees, and visitors.
We reserve the right to refuse service to anyone for any reason at any time. By using our services, you represent that you are at least 18 years of age or have parental consent.
Global Worldwide Express Shipping provides international and domestic logistics solutions including air freight, ocean freight, ground transportation, warehousing, customs brokerage, and express parcel delivery. Service offerings, transit times, and pricing are subject to change based on origin, destination, weight, dimensions, and service level selected.
All shipping estimates (delivery dates, tracking updates) are provided as good-faith estimates. Actual delivery times may vary due to customs clearance, weather, strikes, or other force majeure events. GWE does not guarantee specific delivery times unless a guaranteed service level is purchased (e.g., Next-Day Air).
The following items are strictly prohibited from being shipped via GWE services:
For international shipments, the shipper is responsible for providing accurate customs documentation including commercial invoices, packing lists, certificates of origin, and any required licenses or permits. GWE's customs brokerage services assist with classification and filing, but the shipper retains ultimate responsibility for compliance with import/export laws.
Any duties, taxes, or customs broker fees imposed by government authorities are the responsibility of either the shipper or consignee as designated on the shipping label. GWE may pay such charges on your behalf and invoice you accordingly. Delays caused by inaccurate or missing documentation are not the responsibility of GWE.
All shipping charges must be paid prior to shipment release or within the invoice terms for approved credit customers. Accepted payment methods include credit cards (Visa, Mastercard, American Express), wire transfers, company checks, and approved corporate accounts.
Additional fees may apply including but not limited to: fuel surcharges, remote area delivery fees, oversized/overweight handling fees, storage fees for unclaimed shipments, customs disbursement fees, and address correction fees. All fees are non-refundable after shipment has been tendered to a carrier.
Late payments incur interest at 1.5% per month or the maximum allowed by law. Collection costs, including attorney fees, are the responsibility of the customer.
Unless additional declared value insurance is purchased, GWE's liability for loss or damage is limited to the lesser of (a) the actual value of the shipment or (b) $100 USD per shipment (or $20 USD per kilogram for international shipments, subject to carrier tariffs). This limitation applies to all claims.
Customers may purchase additional transit insurance at checkout. Insurance claims must be filed within 14 days of delivery date for damage, or within 21 days for lost shipment. Proof of value (invoices, receipts) is required. GWE is not liable for consequential, indirect, or special damages including lost profits, business interruption, or reputational harm.
Exclusions: No liability for damage caused by improper packing, inherent vice, perishable nature, acts of God, war, terrorism, government seizure, or force majeure events.
Delivery is considered complete when the shipment is signed for at the destination address or when delivery confirmation is obtained via photo or electronic signature. If no one is available to accept delivery, a delivery notice will be left. Unclaimed shipments may be subject to return shipping fees or disposal after 15 days.
Claims Procedure:
Claims may take 30-60 days to process. GWE reserves the right to inspect damaged shipments before approving any claim payment.
Our website and tracking portal are provided "as is" and "as available" without warranties of any kind. While we strive for accuracy, we do not guarantee that tracking information, transit times, or rates are error-free. We reserve the right to correct any errors or inaccuracies.
You agree not to: (a) use any automated system to scrape or extract data from our site; (b) interfere with security features; (c) impersonate any person or entity; (d) upload malicious code or engage in any activity that disrupts our services.
Intellectual property: All content, logos, trademarks, and software are owned by GWE or its licensors. Unauthorized use is prohibited.
You agree to indemnify, defend, and hold harmless Global Worldwide Express Shipping, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to: (a) your violation of these Terms; (b) your shipment containing prohibited or dangerous goods; (c) your violation of any applicable law or regulation; (d) any dispute between you and a consignee regarding delivery or payment.
To the maximum extent permitted by law, in no event shall Global Worldwide Express Shipping be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with these terms or the use of our services, including but not limited to lost profits, loss of data, business interruption, or reputational harm, even if advised of the possibility of such damages.
Our total aggregate liability for any claim arising from these terms or our services shall not exceed the amount paid by you for the specific shipment giving rise to the claim, or $500 USD, whichever is less. This limitation applies regardless of the legal theory on which the claim is based.
GWE may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will cease immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and governing law) shall survive.
These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of our services shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to personal jurisdiction and venue in those courts.
For claims under $10,000, either party may elect to resolve the dispute through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in New York, NY.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will notify you via email or a prominent notice on our website at least 30 days before the changes take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after revisions become effective, you agree to be bound by the revised terms.
